OneCircle Connect Terms of Use: Effective Date: July 13, 2024
1. Acceptance of Terms Welcome to OneCircle Connect. By accessing and using our services, you agree to comply with and be bound by the following Terms of Use. If you do not agree to these terms, you must not use our services.
2. Definitions "Service" refers to OneCircle Connect’s telecommunications solutions, including the NEOS X2 Smartphone, Ax-Fi Mobile Hotspot, SIM cards, and associated data plans (PlanetWide and NorthNet). "We," "Us," and "Our" refer to OneCircle Connect, a division of OneCircle Energy. "You" and "Your" refer to the user of our services.
3. Use of Service 3.1 Eligibility: You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you have the legal capacity to enter into this agreement. 3.2 User Account: To access certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and are fully responsible for all activities that occur under your account. 3.3 Prohibited Conduct You agree not to: a. Use the Service for any illegal or unauthorized purpose. b. Interfere with or disrupt the integrity or performance of the Service. c. Attempt to gain unauthorized access to any aspect of the Service. 4. Products and Services 4.1 NEOS X2 Smartphone The NEOS X2 Smartphone comes bundled with a 12-month global unlimited data plan. Use of the smartphone is subject to the terms of the bundled data plan. 4.2 Ax-Fi Mobile Hotspot The Ax-Fi Mobile Hotspot provides portable and reliable internet access. Data plans for the hotspot are flexible and subject to the terms outlined during purchase. 4.3 SIM Cards and eSIMs Our SIM cards and eSIMs offer global and region-specific data, calls, and text plans. Usage of SIM cards is subject to the terms of the selected plan.
4.4 Data Plans a. PlanetWide: Unlimited data, calls, and texts across 149 countries. b. NorthNet: Unlimited data, calls, and texts across North America. c. Both plans include a US phone number and are free from roaming charges.
5. Privacy Policy Your use of the Service is also governed by our Privacy Policy. Please review it to understand our practices.
6. Intellectual Property 6.1 Ownership All content and materials provided through the Service, including but not limited to text, graphics, logos, and software, are the intellectual property of OneCircle Connect and are protected by applicable intellectual property laws.
6.2 Limited License You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal and non-commercial use only.
7. Disclaimer of Warranties The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability To the maximum extent permitted by law, OneCircle Connect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: Your use or inability to use the Service. Any unauthorized access to or use of our servers and/or any personal information stored therein. Any interruption or cessation of transmission to or from the Service.
9. Indemnification You agree to indemnify, defend, and hold harmless OneCircle Connect, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service.
10. Modifications to the Service and Terms We reserve the right to modify or discontinue the Service at any time without notice. We also reserve the right to change these Terms of Use at any time. Your continued use of the Service after such changes will constitute your acceptance of the new terms.
11. Governing Law These Terms of Use shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.
